Law to install electric vehicle charging stations without consent of neighbors approved on first reading

According to the proposal formulated by the Ministry of Justice and submitted by Minister Levin, a charging station can be connected to an apartment’s electricity connection or to an existing designated electricity connection in the parking area adjacent to the apartment, even without the consent of the other apartment owners, as long as the rules and appearance of the building are maintained.

On Monday night, The Knesset plenum approved the bill’s first reading to regulate the installation of electric vehicle charging stations in condominiums. The bill, which was formulated by the Ministry of Justice and submitted by Minister Yariv Levin, proposes that in parking areas adjacent to the apartments, a charging station can be connected to an apartment’s electricity connection or an existing designated electricity connection, even without the consent of the other apartment owners, as long as the rules and appearance of the building are maintained.

According to the proposal, with the consent of most apartment owners, it will be possible to connect an electric charging station to a public electricity connection that serves the common property using a separate meter. In addition, in parking areas that are part of the shared property, it will be possible to install a charging station with the consent of a special majority of two-thirds of the apartment owners. This majority will also determine the arrangements for using the charging station, considering the needs of all apartment owners who use the shared parking spaces.

The Legal Advice and Legislation (Civil Law) Department of the Ministry of Justice prepared the bill, headed by Deputy Legal Advisor to the Government (Civil Law), Adv. Carmit Yulis, in cooperation with the relevant government bodies in the Ministry of Finance, the Electricity Authority in the Ministry of Energy, and the Land Rights Registration and Settlement Authority. 

Deputy Prime Minister and Minister of Justice, MK Yariv Levin: “The purpose of the law is to establish a balance between the rights of apartment owners and the desire to ease and remove barriers to the installation of charging stations, in light of the public interest in promoting the use of less polluting vehicles.”

Deputy Attorney General (Civil Law), Adv. Carmit Yulis: “The bill is intended to help increase the use of electric vehicles while preserving the rights of all apartment owners. It is expected to create certainty and reduce disputes between neighbors.”
